Delhi HC likely to pass order on petition against Sonia

The Delhi High Court is expected to pass a judgement today on a petition filed by an NGO challenging the holding of public offices, including the post of Congress chief, by Sonia Gandhi who is italy-born.

A Division Bench comprising Acting Chief Justice Vijender Jain and Justice Rekha Sharma will deliver the order on the petition filed by Rashtriya Mukthi Morcha, an NGO.

The petition, which has been pending since 1999, seeks to question Gandhi’s right under the Constitution to be elected or appointed to any public office in the country.

The petition had invoked Article 5 of the Constitution which bars “non-citizens” from public offices.

it also alleged the Election Commission had acted ultra vires the provisions the Representation of the People Act, 1951, by allowing Congress to participate in elections.
