Delhi HC issues notice to Vikas Yadhav

The Delhi High Court today issued notice to Vikas Yadav, a co-accused in the Jessica Lall case, asking him to explain why a case of murder cannot be made out against him.

A Division Bench of Justice R S Sodhi and Justice P K Bhasin expressed disatisfaction over the failure of Yadav’s counsel K N Balgopal to answer a query repeatedly posed by them as to why Yadav cannot be tried for having a common intention behind the murder of Jessica?

The Bench asked him to file a written submission and said, “Take it seriously. We issue a notice to you and you explain us why a case under section 302 (murder) read with 34 of iPC could not be made out against your client”.

The prosecution has charged Yadav with destruction of evidence under section 201 of iPC. Yadav had allegedly removed prime accused Manu Sharma’s car from the place of occurence after the murder on the intervening night of April 29-30, 1999.

On Tuesday, the Bench had grilled Balgopal after he failed to impress the court on a point that whether Tata Safari car, which Yadav had removed from the spot, was a piece of evidence or not?

in his argument, Balgopal denied the presence of his client in the party organised at the Qutub Colonnade on the fateful night.
