The Delhi High Court has demanded an explanation from the Delhi government as to how properties booked for unauthorised construction are being freely bought and sold even though they have not yet been regularised by MCD.
Justice S Murlidhar placed his concern on record recently while dealing with the case of a Pitampura property, which according to the applicant, had been sold through at least four sale deeds to different persons even though it was under MCD scanner for being unauthorised.
“This presents a very disturbing scenario… despite demolition in this property, illegal construction was resumed and court’s orders were violated with impunity. This reflects extremely poorly on MCD which is expected to ensure compliance of HC orders,” the judge observed.
Saying “it is inconceivable that MCD could permit further unauthorised construction and the property to be freely sold without the illegalities being removed first”, Justice Murlidhar pulled up the civic agency.
The applicants, one Sun World Industries Private Limited, had approached the court seeking directions to MCD to “consider” their case for regularisation of the Pitampura property of which they were the latest purchasers.
Significantly, as the court found out to its utter surprise, the sale deeds of all the transaction with respect to this property had a rubber stamp endorsement recording the fact that it had been booked for illegal construction.
On being informed by the MCD counsel that it was not the agency but the Delhi government which regulates registration of sale deeds, the court made the latter a party to the application.
Issuing notice to be served on the chief secretary, the high court has sought information from him on how the government proposes to deal with this problem and whether any order can be issued to the registering authorities forbidding them to register any dubious sale deed and property.
