The Delhi High Court on Wednesday reserved its final order in the sensational Naina Sahani murder case in which former youth Congress leader Sushil Sharma was given death penalty for killing his wife after the counsels for prosecution and defence wrapped up their arguments.
A Bench of Justice R S Sodhi and Justice P K Bhasin reserved their order on the appeal filed by Sharma challenging the trial court judgement after the counsel for prosecution summed up the arguments.
A Delhi court had on November 7, 2003 sentenced Sharma to death for killing his wife Naina at their house in Gole Market area here and later roasting her body in an earthen oven (tandoor) at Baggia Restaurant of Ashok Yatri Niwas Hotel (now named the Shangrila) on the intervening night of July 2-3, 1995.
Earlier, appearing for Sharma, his counsel K K Sud alleged his client had not got a fair trial as the trial judge did not give chance to his client to make his defence properly.
Sud charged the trial judge had relied upon the “false” evidence produced by the police and convicted Sharma. The prosecution had fabricated all evidence, including the revolver, and planted that as a piece of evidence to falsely implicate his client, he alleged.
The suspected weapon was picked up by the police from his house in Delhi and shown that it was recovered from his Maruti car, he argued.
The counsel denied Sharma was staying with Naina at the house in Gole Market, where the murder took place, as he was not legally married to her.
